Ministry of Women and Child Development has formulated a draft Bill on “Trafficking of Persons (Prevention, Protection and Rehabilitation) Bill, 2016” for further consultations with all stakeholders. It aims to create a strong legal, economic and social environment against trafficking of persons and for matters connected therewith or incidental thereto.

The draft Bill has taken in to account the various aspects of trafficking and its punishments as defined in section 370- 373 of Indian Penal Code, 1860 and aims to include other offences/ provisions which are not dealt in any other law for the purpose of trafficking, such as (1) penal provisions for the disclosure of identity of the victim of trafficking and witness (2) use of narcotic drug or psychotropic substance or alcohol for the purpose of trafficking (3) use of chemical substance or hormones for the purpose of exploitation. The draft Bill has also taken in to its ambit the ‘placement agencies’ by making mandatory for them to also register for the purposes of this Act.

The proposed draft Bill aims to place dedicated institutional mechanism at District, State and Central level. It also envisages a designated Agency for the investigation of offences. It provides for Protection Homes and Special Homes for short term and long term rehabilitation support. For speedy trial with a view to increase prosecution and to reduce the trauma faced by the victims, the proposed draft Bill provides for establishing Special Courts in each district and experienced Special Prosecutors. Recovery of back wages and other monetary losses of the victim of trafficking is also proposed.

The draft Bill provides for mandatory reporting within 24 hours by a Police Officer, Public servant, any officer or employee of Protection Home or Special Home having custody of the victim of trafficking to the District Anti-Trafficking Committee or in case of child victim to the Child Welfare Committee. For the effective implementation of the proposed Act and for the welfare and rehabilitation of the victims an Anti- Trafficking Fund will be created.

India is a developing and high population country, begging by Poors, disabled, aged, destitutes cannot be criminalised. But begging by any child below the age of 14 shall be punishable offence for parents and gardians of such child. More harsh punishment to organised gang or individuals for forcing or facilitating such begging activities by Children. Additional harsh punishment for kidnapping , misguiding and taking away kids and children for selling or prostitution, trading of organs, begging.

DNA bank should be maintained by govt. Women using babies for begging should under go DNA test with the child. Almost all the babies they use are stolen from hospitals. All these children are given heavy dose of drugs so that they are always SLEEPING. Records of DNA test of the original parent should be matched with the children. Original parents and children should be met.Beggers using stolen children for begging should be sent for life sentence.

It's really good about the Ruling Government , it has taken a good step to bring accountability for a subject which has been just a debate for all and for victim just a worst than a hell. Wish each Gov., Judiciary System is empowered to do a transparent justice where the culprits should be tagged as a National Criminal and people in support to the system to be tagged as National Criminal. Law to ne drafted very crisp so that a smallest of Jawan should be empowered to file FIR's.

I Have few Ideas,they are i)Initially there should be a general awareness should be created among the public through media(TV,FM Radio,Newspapers,social media) importance knowing about Human Trafficking,ii)In School,Colleges there should be strong awareness created among every single of the institution,iii)Through digital India an mobile App that can be created to share during emergency of Human Trafficking,iv)There should be strict law against the persons invovled(citzenship must be cancelled)

AS our police has all these information, so first they should accountable to share and have close watch on child labor and children bagging on streets. and also information regarding the ladies from college authorities and hostel authorities and they must provides the details time to time to local police station if any misbehaving observed.

A trafficked person lives in almost a permanent hell, (s)he is scarred for life, hence there must be simple reporting mechanisms(online), trial must be very quick & there must be death penalty. The deterrent must be stronger than rape because a rape may get reported but a trafficked person may get raped day & night without any reporting. A half hour program on TV showing missing children pics and their likely addresses will also be a big help to people in remote areas.

WOMEN WITH 0-3 YEARS AGE CHILD ATTRACTING PUBLIC FOR BEGGING. 3. IN BUS STAND, HEAVY ROAD SIGNALING WHILE CROSSING TRAFFIC LIGHTS. 4. PASSENGER TRAIN OR GENERAL COMPARTMENT OF TRAINS. 5. BUS DEPOTS AND PUBLIC PARK. 6. MOST PUBLIC GATHERING TEMPLES, CHURCH, MOSQUE ETC.

To ensure trafficking of a person, primary responsibility at village level should be of Sarpanch and Panchayat Secretary as they have good knowledge of poor people who migrate for the purpose of seeking seasonal job here and there. 2. Identification of families at village who have daughters but their earning is less to meet out expenditure and provisioning of govt. assistance fairly not withstanding their cast and creed and religion. If possible provide monitory assistance through govt scheeme.
