Ministry of Women and Child Development has formulated a draft Bill on “Trafficking of Persons (Prevention, Protection and Rehabilitation) Bill, 2016” for further consultations with all stakeholders. It aims to create a strong legal, economic and social environment against trafficking of persons and for matters connected therewith or incidental thereto.

The draft Bill has taken in to account the various aspects of trafficking and its punishments as defined in section 370- 373 of Indian Penal Code, 1860 and aims to include other offences/ provisions which are not dealt in any other law for the purpose of trafficking, such as (1) penal provisions for the disclosure of identity of the victim of trafficking and witness (2) use of narcotic drug or psychotropic substance or alcohol for the purpose of trafficking (3) use of chemical substance or hormones for the purpose of exploitation. The draft Bill has also taken in to its ambit the ‘placement agencies’ by making mandatory for them to also register for the purposes of this Act.

The proposed draft Bill aims to place dedicated institutional mechanism at District, State and Central level. It also envisages a designated Agency for the investigation of offences. It provides for Protection Homes and Special Homes for short term and long term rehabilitation support. For speedy trial with a view to increase prosecution and to reduce the trauma faced by the victims, the proposed draft Bill provides for establishing Special Courts in each district and experienced Special Prosecutors. Recovery of back wages and other monetary losses of the victim of trafficking is also proposed.

The draft Bill provides for mandatory reporting within 24 hours by a Police Officer, Public servant, any officer or employee of Protection Home or Special Home having custody of the victim of trafficking to the District Anti-Trafficking Committee or in case of child victim to the Child Welfare Committee. For the effective implementation of the proposed Act and for the welfare and rehabilitation of the victims an Anti- Trafficking Fund will be created.

ALL CHILD BEGGARS SHOULD BE KEPT IN PROTECTION HOME.BEGGARS WITH CHILDREN SHOULD ALSO BE KEPT IN SOCIAL SHELTER. FINGER PRINT OF ALL NEW BORN SHOULD BE TAKEN IN PRESCRIBED TIME.THIS WILL HELP IN DETECTING NATIVE OF VICTIMS. NO CHILD SHOULD WORK IN PRIVATE PLACE OR IN ANY HOME.

I would highly recommend the involvement of those who have been trafficked or who work as sex workers be involved in drafting this bill. Provisions need to be made in this bill for dignity of labour and for removing stigma around a trafficked person. Emphasize on the correct terminology and use of words like prostitute and other version should be made an offense. Counseling, therapy and medical treatment and should be part of rehabilitation. #DraftTraffickingofPersonsBill2016 #HumanTrafficking

2. One of the most important aspect is the identify the categories of the possible targets for the Trafficking. These are 1) Kids - MOST Vulnerables 1a) Girl-Child-homeless-Parentless - Most-most-most vulnerable 1b) Boy-Child-homeless-Parentless- Most-most vulnerable 2) Mentally Challenged Person 3) Physically Challenged Persons Intention of creating this identification is to Prevent the Trafficking to happen for this MOST VULNERABLE Group of Person/Kids. D. READ only access of the Trafficking knowledge Centre to All DISTRICTS, STATES and CENTRAL authorities including Police, Ministries etc. E. Training and Expertize development of Anti-Trafficking EXPERTs. Special Training should be given to selected teams from USA/Europe in this subject. F. A special course/study should be created in Delhi University for Research with latest challenges in mind.

After Reading the Draft Trafficking Of Persons Bill 2016, here are the shortcoming in the Draft: 1. Draft doesn't talk about the Knowledge Assets. These knowledge assets are online records of the A. Criminals Database involved in the Trafficking - Bio-metrics like eye-scan, finger scan etc. B. 360 degree physical identification - Video Graphs and Photographs of Criminal C. Knowledge captured from Criminal in building the awareness of Trafficking ECOSystem existing in country.

CHAPTER VII REHABILITATION AND SOCIAL INTEGRATION - If the aim is to rehabilitate and reintegrate women back into the society, you need a specialist and skilled group of workers for that - students who have studied psychology, social work, criminology etc. Students who have theoretical knowledge but not many opportunities to learn and hone their skills. We also need better research in this field. Government should fund projects and employ post-graduate research students to explore these issues.

If police is not effective, instead of creating a new task force and increasing the overhead costs shouldn't the government focus on improving the police force. The reluctance of police to file FIR's is one major problem. Just a suggestion, shouldn't using electronic means of filing FIR's minimise such incidents, the concerned authority can monitor the FIR and take action and if his response is found to be inadequate, they will be more accountable.
