Ministry of Women and Child Development has formulated a draft Bill on “Trafficking of Persons (Prevention, Protection and Rehabilitation) Bill, 2016” for further consultations with all stakeholders. It aims to create a strong legal, economic and social environment against trafficking of persons and for matters connected therewith or incidental thereto.

The draft Bill has taken in to account the various aspects of trafficking and its punishments as defined in section 370- 373 of Indian Penal Code, 1860 and aims to include other offences/ provisions which are not dealt in any other law for the purpose of trafficking, such as (1) penal provisions for the disclosure of identity of the victim of trafficking and witness (2) use of narcotic drug or psychotropic substance or alcohol for the purpose of trafficking (3) use of chemical substance or hormones for the purpose of exploitation. The draft Bill has also taken in to its ambit the ‘placement agencies’ by making mandatory for them to also register for the purposes of this Act.

The proposed draft Bill aims to place dedicated institutional mechanism at District, State and Central level. It also envisages a designated Agency for the investigation of offences. It provides for Protection Homes and Special Homes for short term and long term rehabilitation support. For speedy trial with a view to increase prosecution and to reduce the trauma faced by the victims, the proposed draft Bill provides for establishing Special Courts in each district and experienced Special Prosecutors. Recovery of back wages and other monetary losses of the victim of trafficking is also proposed.

The draft Bill provides for mandatory reporting within 24 hours by a Police Officer, Public servant, any officer or employee of Protection Home or Special Home having custody of the victim of trafficking to the District Anti-Trafficking Committee or in case of child victim to the Child Welfare Committee. For the effective implementation of the proposed Act and for the welfare and rehabilitation of the victims an Anti- Trafficking Fund will be created.

India has over 18 million slaves, highest in the world. We see children and families on every corner of the street. Even if they are not slaves their living condition is pretty much the same. Make the bill as less complicated as possible and do simple things first like keeping all the people off the street. Give them a 3 time meal and in exchange engage them in various community services like cleanliness etc. Any job is better than begging. To stop trafficking ask the people who've experiencedit

Government's initiative of preventing human trafficking is commendable. I wish to throw light on the other side of the coin.Human trafficking is a business of human flesh. Government can take steps in cutting down the market(demand) so the supply would automatically reduce. All of the following should be penalized equal to those involved in human trafficking: 1)Websites displaying mobile numbers or any contact details of pimps. 2)People taking these services. 3)Police in-charge of the area.

मानव तस्करी का विकास के साथ गंभीर संबंध है, यह गांव से शहरों की ओर ज्यादा है। गांव में एैसी पुख्ता व्यवस्था की जाय जिससे इस काम में लगे व्यक्तियों में कानून के प्रति सम्मान की भावना पनपे। एैसे लोगों के लिए कठोर कानून हो, आघुनिक समय में तकनीक के सहारे प्राप्त तथ्य व सबूत को मान्यता दी जावे। जिला व तहसिल स्तर पर सतत् निगरानी तंत्र विकसित किया जाये

The linking of aadhar no at immigration can verify the details of person. Also the aadhar card should have additional details of the parent of the child. At the time of birth, finger print of the child and mother should be taken and linked to each other for records. More the reference less the chance of trafficking.

1.Trafficking should be properly defined in the BILL.(Definition of Trafficking is missing in the draft bill). 2.All people responsible for Prevention, Protection and Rehabilitation of persons must be selected on pure merit and such persons should be of high character and reputation in the society. 2. Judges, Investigating Officer, all members of district, state COMMITTEE or Central Anti- Trafficking Advisory Board should be themselves of people who are respected in societ due to their work.
