Ministry of Women and Child Development has formulated a draft Bill on “Trafficking of Persons (Prevention, Protection and Rehabilitation) Bill, 2016” for further consultations with all stakeholders. It aims to create a strong legal, economic and social environment against trafficking of persons and for matters connected therewith or incidental thereto.

The draft Bill has taken in to account the various aspects of trafficking and its punishments as defined in section 370- 373 of Indian Penal Code, 1860 and aims to include other offences/ provisions which are not dealt in any other law for the purpose of trafficking, such as (1) penal provisions for the disclosure of identity of the victim of trafficking and witness (2) use of narcotic drug or psychotropic substance or alcohol for the purpose of trafficking (3) use of chemical substance or hormones for the purpose of exploitation. The draft Bill has also taken in to its ambit the ‘placement agencies’ by making mandatory for them to also register for the purposes of this Act.

The proposed draft Bill aims to place dedicated institutional mechanism at District, State and Central level. It also envisages a designated Agency for the investigation of offences. It provides for Protection Homes and Special Homes for short term and long term rehabilitation support. For speedy trial with a view to increase prosecution and to reduce the trauma faced by the victims, the proposed draft Bill provides for establishing Special Courts in each district and experienced Special Prosecutors. Recovery of back wages and other monetary losses of the victim of trafficking is also proposed.

The draft Bill provides for mandatory reporting within 24 hours by a Police Officer, Public servant, any officer or employee of Protection Home or Special Home having custody of the victim of trafficking to the District Anti-Trafficking Committee or in case of child victim to the Child Welfare Committee. For the effective implementation of the proposed Act and for the welfare and rehabilitation of the victims an Anti- Trafficking Fund will be created.

OFFENCES AND PENALTIES 13. Any person in-charge of Protection Home or Special Home providing shelter to the victims contravenes any of the provisions of section 10, shall be punished with imprisonment which may extend to one year or with a fine not less than one lakh rupees, or with both. add deemed provision in above. Any person having some association with Protection home or special home shall be deemed as person in charge.

I think we should have a central repository or website for all the missing people, kids, women: 1. Details of the missing person can be added to the repository. If found by anyone,that should be the only place to check the details of the missing person. 2. Recently I see many posts on Facebook that they see kids in foreign people hands, those posts/pictures can be uploaded to the repository 3. Try to add fb/google technology for face recognition 4. Add awards facility for reporting missing

1. As many have already pointed out campaigning, training and spreading awareness are very crucial. There has been mass awareness campaign for various matters like AIDS prevention, population control etc. but I have come across very few billboards or messages on print/electronic media cautioning against trafficking. 2. To ensure effectiveness it is better to first identify those pockets in which trafficking rate is particularly high. I think every state has such specifically identifiable areas

The reasons for human trafficking is 1. Prostitution 2. Begging 3.Working as slaves. My comments are as 1. GOVT shall address these issues one by one means what shall be done . 2.I unable to see the word responsible in the draft. Who is responsible if the human trafficking case happens shall be addressed. Some body shall be made responsible. 3. Needs a special procedures and courts to deal with. Anybody can see the money earned in internet by Human Trafficking.

The concept is great in all respects. The law and system has to add on few things: 1)The women and children should be looked after by the family and citizens in the best manner upholding their self esteem as initial moves. 2) We need safe neighbourhood concept in every streets of this country.The policing should be on high alert( just like we do have common number 111 in New Zealand for Police/Ambulance/Fire). These easy numbers help public to alert law protectors to take action instantly.

It's Great that we are comming up with this law. 1. Educate: Educate students in all schools and members of Anganwaadi about trafficking of children and women.Picture boards and instruction. 2. Punishment: Nothing less than Capital punishment or life imprisonment. 3. Implementation: We make good laws but we fail miserably in implementation. Strict punishment for showing slightest neglect, ignorance,laziness on the issue and misbehavior to the victim or family members by enforcement agency

child trafficking issue can be addressed in 3 ways. 1. precaution: all schools gram panchayats needs to be provided with a manual to teach children about how to deal with strangers & sometimes known 2. senstivity & persecution: all state police to be sensitive towards the epathy of the missing child parents. have national control room in this matter. 3. execution: laws like capital punishment for the rapist of the child. people operating as gangs should be put under macoca and tight laws

Ofcourse human trafficking is a serious crime.Children and women are its biggest victims.Children are made handicapped to force them into begging which is just so traggic..prevention ofcourse is imp...for that begging by small children must be stopped...and for girls forced into prostitution against their will...the brothels and kothas must be raided from time to time .A very strict action from police is must required.police can't just take hafta and allow these things to run.
