Ministry of Women and Child Development has formulated a draft Bill on “Trafficking of Persons (Prevention, Protection and Rehabilitation) Bill, 2016” for further consultations with all stakeholders. It aims to create a strong legal, economic and social environment against trafficking of persons and for matters connected therewith or incidental thereto.

The draft Bill has taken in to account the various aspects of trafficking and its punishments as defined in section 370- 373 of Indian Penal Code, 1860 and aims to include other offences/ provisions which are not dealt in any other law for the purpose of trafficking, such as (1) penal provisions for the disclosure of identity of the victim of trafficking and witness (2) use of narcotic drug or psychotropic substance or alcohol for the purpose of trafficking (3) use of chemical substance or hormones for the purpose of exploitation. The draft Bill has also taken in to its ambit the ‘placement agencies’ by making mandatory for them to also register for the purposes of this Act.

The proposed draft Bill aims to place dedicated institutional mechanism at District, State and Central level. It also envisages a designated Agency for the investigation of offences. It provides for Protection Homes and Special Homes for short term and long term rehabilitation support. For speedy trial with a view to increase prosecution and to reduce the trauma faced by the victims, the proposed draft Bill provides for establishing Special Courts in each district and experienced Special Prosecutors. Recovery of back wages and other monetary losses of the victim of trafficking is also proposed.

The draft Bill provides for mandatory reporting within 24 hours by a Police Officer, Public servant, any officer or employee of Protection Home or Special Home having custody of the victim of trafficking to the District Anti-Trafficking Committee or in case of child victim to the Child Welfare Committee. For the effective implementation of the proposed Act and for the welfare and rehabilitation of the victims an Anti- Trafficking Fund will be created.

Install CCTV cameras of very good quality on airports,railway stations , bus stands and other sensitive places. Keep recordings of these cameras saved at least for one year. Give strict punishment to the criminals involved in human trafficking. Be cruel to them. Make a list of the people living in holy ashrams of every religion. Fill forms describing their details. Even a small attempt for human trafficking must be viewed very seriously and should be resulting big punishment to the criminals.

Keep a list of agents who claim to send people abroad and helping in getting jobs any other city. Disclose the previous activities of these agents and in case of any doubt ( whether they may be defaulter in other activities ) , take strict actions against them. Publish punishments against this crime in newspapers etc. Instruct police department to take these cases seriously. Keep mobile phones of the doubtful persons under surveillance. Keep recordings of persons going abroad.

Keep DNA test record of beggars , child-laborers and prostitutes. Publish phone numbers , e-mail IDs and addresses of District wise Govt Departments/NGOs in newspapers and TV channels to give information about the missing people. Register complaints of the people quickly. In case of children and women to be sent abroad , get consent of at least other two family members allowing them to go abroad or out of city. Keep a close eye on the advertisement claiming helping to go abroad and availing jobs

First of all , make a district wise list of all people i.e. women , children and men who are misplaced. Have their complete details with photographs along with details of their family members with photographs. Publish this all on a website related to missed people. Make a list of people who apply for VISA of any country. Keep all record of the persons who send people to abroad. Make complete record of beggars and whores ( may be forced to ). Make strict ( non-bailable ) laws for it .

Laws needed to be implemented with sincere efforts. Kidnapping, child labour, prostitution, begging should be dealt with iron hand. There should be a national database of DNA of both the kidnapped children's and their parents. This should be priority of the Government. The nexus exists between the gangs and the corrupt officials and this needs to be broken at any cost. Now that there is majority in the Rajya Sabha we can dream of new tough laws.

There is no where mentioned in the draft about psychologists who can deal with them appropriately and also life skill programmes and other vocational training .The addition of the victims to the skill india programme and other initiative may be a huge boost and also it is not mentioned clearly about the girls child who are in prostitution for many year so how can you treat them as a victim or as a initiator or the criminal in the following act.

My suggestion in attachment draft bill marked in yellow, as you click on yellow portions, a pop window will appear containing remarks. when you draft rules, want to give suggestions for control over functioning of Shelter Homes, Protection homes, NGOs and placement agencies. If strict rules will not be made for the, purpose of this proposed act will be defeated. This bill is last hope for the girls and women pushed into hell of prostitution and bonded labor through trafficking mafia.
