Ministry of Women and Child Development has formulated a draft Bill on “Trafficking of Persons (Prevention, Protection and Rehabilitation) Bill, 2016” for further consultations with all stakeholders. It aims to create a strong legal, economic and social environment against trafficking of persons and for matters connected therewith or incidental thereto.

The draft Bill has taken in to account the various aspects of trafficking and its punishments as defined in section 370- 373 of Indian Penal Code, 1860 and aims to include other offences/ provisions which are not dealt in any other law for the purpose of trafficking, such as (1) penal provisions for the disclosure of identity of the victim of trafficking and witness (2) use of narcotic drug or psychotropic substance or alcohol for the purpose of trafficking (3) use of chemical substance or hormones for the purpose of exploitation. The draft Bill has also taken in to its ambit the ‘placement agencies’ by making mandatory for them to also register for the purposes of this Act.

The proposed draft Bill aims to place dedicated institutional mechanism at District, State and Central level. It also envisages a designated Agency for the investigation of offences. It provides for Protection Homes and Special Homes for short term and long term rehabilitation support. For speedy trial with a view to increase prosecution and to reduce the trauma faced by the victims, the proposed draft Bill provides for establishing Special Courts in each district and experienced Special Prosecutors. Recovery of back wages and other monetary losses of the victim of trafficking is also proposed.

The draft Bill provides for mandatory reporting within 24 hours by a Police Officer, Public servant, any officer or employee of Protection Home or Special Home having custody of the victim of trafficking to the District Anti-Trafficking Committee or in case of child victim to the Child Welfare Committee. For the effective implementation of the proposed Act and for the welfare and rehabilitation of the victims an Anti- Trafficking Fund will be created.

There should be a free constitutional and judicial body in every village/district (like CBI) to stop political interference in these cases. The victim should be rehabbed and counselled under the eye of this body. This body should not be abide by state government and should be in command to control or order the local police. This should be greatly and very strictly enforced in Haryana, Punjab, western Rajasthan, West Bengal and New Delhi.

Secondaly, the goverment should pay better or high allowances to the people/team engaged in this work, so that there will not be any or will be minimum scope of corruption. The whistleblowers name should not be disclosed and the DM/SP of the region should directly take the responsibility for his/her safety. By this, we can come up with more cases to be in view. Police of every region should have strict orders to be polite, not to torture or not to put wrong intention questions to victim.

Dear Sir, Firstly, I would like to submit that the laws should be very strong and impactful at Tehsil and village level, as so many girls and children abducted and taken from there to cities and metropolitans. The counselling classes, ADM of Tehsils, Collectors of the region, Commisioners should enforce a team or rather a seperate department of the people who should be given special training to counsell the victims, villagers and other people and to counter attack such activities on the spot.

Human trafficking is a curse to our society and nation.Devil minded anti social elements are involved in this business since they take law for granted.The law maintaining agencies do not discharge their duties sincerely.Many women and girls are leading hell life in brothel.They are still slave.They must have bank account and insurance to help them when turned old.Sever punishment s only solution to deter the goons.All brothel may be converted in to vocational training center under re-habitlion

I feel the major challenge is stop beggars on road.The origin of trafficking starts from abduction of childs and later force them in to begging like "things". If begging stops then 70-80 % trafficking can be stopped. Also beggars can be categorised as healthy / handicapped..those found healthy should be punished and handicapped should be given sanctioned a pension. Secondly prostitution should be curbed and life imprisonment should be given for those who forces womens in prostitution.

1. The bill should also contain the penalty when anybody misuses the law / impact of act. 2. The criminal should be dealt with punishment but of that kind where he is also counselled and transformation should be there. 3. Everybody in India should be given military training right from the primary education. Kungfu, Judo, Karate should be in syllabus of schools. Yoga, meditation should be introduced for introspection. 3. Good moral values should be given to all in prison and outside too.

* Ensure people are aware of basic safety principles by organizing workshops in backward areas. * Establish help centres at district levels for classification and help for victims. * Special task forces and committees to decide suitable course of action for victims. * Psychological treatment to ensure the victims can lead a normal life, if they have been gravely affected. * Fast track courts vested with enough power to punish traffickers.

. In provision there should be special task force and Special task police officer having a power of special warrant in electronic mod. Cases should be handled on fast track court. These types of cases should be closed within 1 month. Digital blackmailing should be stopped by enforcing imprisonment of life time. CC TV camera should be installed in every public place.
