Ministry of Women and Child Development has formulated a draft Bill on “Trafficking of Persons (Prevention, Protection and Rehabilitation) Bill, 2016” for further consultations with all stakeholders. It aims to create a strong legal, economic and social environment against trafficking of persons and for matters connected therewith or incidental thereto.

The draft Bill has taken in to account the various aspects of trafficking and its punishments as defined in section 370- 373 of Indian Penal Code, 1860 and aims to include other offences/ provisions which are not dealt in any other law for the purpose of trafficking, such as (1) penal provisions for the disclosure of identity of the victim of trafficking and witness (2) use of narcotic drug or psychotropic substance or alcohol for the purpose of trafficking (3) use of chemical substance or hormones for the purpose of exploitation. The draft Bill has also taken in to its ambit the ‘placement agencies’ by making mandatory for them to also register for the purposes of this Act.

The proposed draft Bill aims to place dedicated institutional mechanism at District, State and Central level. It also envisages a designated Agency for the investigation of offences. It provides for Protection Homes and Special Homes for short term and long term rehabilitation support. For speedy trial with a view to increase prosecution and to reduce the trauma faced by the victims, the proposed draft Bill provides for establishing Special Courts in each district and experienced Special Prosecutors. Recovery of back wages and other monetary losses of the victim of trafficking is also proposed.

The draft Bill provides for mandatory reporting within 24 hours by a Police Officer, Public servant, any officer or employee of Protection Home or Special Home having custody of the victim of trafficking to the District Anti-Trafficking Committee or in case of child victim to the Child Welfare Committee. For the effective implementation of the proposed Act and for the welfare and rehabilitation of the victims an Anti- Trafficking Fund will be created.

First of all Definition clause of Trafficking should be included in the ACT. Nowadays fake social ID play a major role to Trafficking. In my opinion Social ID should be linked identity card of people. Therefore Fake ID cannot be generated. Trafficking is a very serious crime so that punishment should be minimum 10 years jail and life term also. In case of child / women who are trafficked- there should be provision of moral education.

1.This bill do not define as to what constitutes "Trafficking of Persons". Unless the bill defines and punishes the trafficking itself it will be of no use as it will loose its character of being preventive.2.In place of anti trafficking committees the bill should provide for creation of anti trafficking sqad in every district police as well as in GRP.3. The district anti trafficking committee should provide for two young lawyers having no political affiliation aged35-45yrs as its members.

AT THE PRESENT SITUATION THOUSANDS OF GIRLS GO MISSING EACH YEAR.THEIR POTENTIAL AND SKILL IS OPPRESSED AND THEY ARE MADE TO SERVE DEVILS.A WHOLE GENERATION IS DESTROYED.ACC.TO ME DEATH PENALTY SHOULD BE GIVEN IMMEDIATELY TO RAPISTS AND TRAFFICKERS#NO MERCY

The day before yesterday, I was at Anand Railway station. There were some girls/boys/infant sitting over there. I told them, where is his(infant) mother and why you took him here in this hot temperature? One of the girl was replying me meanwhile another girl stop her and told her to stay away from conversion. After sometimes train comes and they all rush to the train with infant... for bagging.... Its become business, so no need to protect them. Just make policy to stop this.....

While passing through Gurgaon traffic lights, I always see several beggars: men, women, children and infants. Seems begging has become lucrative business & organized crime having deep roots in administrative and political system. The children knocking at windshield simply reminds me of our responsibility of providing them a safe childhood. No wonder these children and woman exploited mentally & sexually. The new policy must ban begging at all places. Need to destroy the network.

Try to create a authority where we can complain about human trafficking & also we can Track our request & simultaneously user identity should be protected,I knw at many places kids of age 5-10 are working 14 hrs a day and getting 1 time food ,i cannot complain as there is no direct authority responsible is available in our system, make sure tht the if person caught doing human trafficking under 18 years should not get bail ,try to introduce rules like "pocso act" and also include child labour.

All complaint Portals need to be made online and reply to such complaints should go in a time bound manner. Should be monitored at highest level to ensure replies to all complaints go in a time bound manner. This will automatically get desired attention of authorities at all levels. Further, there should be a system of Appeal. When an individual is not satisfied with the first reply received, can file an online Appeal to a higher Officer in that organisation. Final Appeal be made with NHRC.

2016 Bill must have provisions against involvement of Emmigration and security officials at airports which facilitates human trafficking. Also provisions against ticketing agents who are human traffickers hiding as tours and travel agents. Also track all tourists VISA's issued from Middle East,Malaysia and other nations proned for trafficking destinations.
