The law enforcement agency placed under a State’s authority nullifies its impartiality in dispensing law and order. A new model is suggested. The model envisages establishment of an ‘Independent Commission’ to control and oversee its duties and functions. It shall have three members, 1) the state’s Home Minister, the directive authority, 2) a member chosen by and from the state’s judiciary, the legal authority, 3) the State’s Governor, the figurehead of the IC. The commission shall function like a ‘collective ombudsman’ with the authority to receive complaints of irregularity from the public and to initiate separate enquiries. The statutory directive power of a State in law enforcement is exercised through the ‘Law Enforcing Agency’. Lead by a Commissioner, this agency will perform the assigned tasks in accordance to the ‘Standard Protocols and Practices in Law Enforcement’ so established. ‘Directives’ shall be issued in situations where the ‘Protocols’ are insufficient or are absent.
