Ministry of Women and Child Development has formulated a draft Bill on “Trafficking of Persons (Prevention, Protection and Rehabilitation) Bill, 2016” for further consultations with all stakeholders. It aims to create a strong legal, economic and social environment against trafficking of persons and for matters connected therewith or incidental thereto.

The draft Bill has taken in to account the various aspects of trafficking and its punishments as defined in section 370- 373 of Indian Penal Code, 1860 and aims to include other offences/ provisions which are not dealt in any other law for the purpose of trafficking, such as (1) penal provisions for the disclosure of identity of the victim of trafficking and witness (2) use of narcotic drug or psychotropic substance or alcohol for the purpose of trafficking (3) use of chemical substance or hormones for the purpose of exploitation. The draft Bill has also taken in to its ambit the ‘placement agencies’ by making mandatory for them to also register for the purposes of this Act.

The proposed draft Bill aims to place dedicated institutional mechanism at District, State and Central level. It also envisages a designated Agency for the investigation of offences. It provides for Protection Homes and Special Homes for short term and long term rehabilitation support. For speedy trial with a view to increase prosecution and to reduce the trauma faced by the victims, the proposed draft Bill provides for establishing Special Courts in each district and experienced Special Prosecutors. Recovery of back wages and other monetary losses of the victim of trafficking is also proposed.

The draft Bill provides for mandatory reporting within 24 hours by a Police Officer, Public servant, any officer or employee of Protection Home or Special Home having custody of the victim of trafficking to the District Anti-Trafficking Committee or in case of child victim to the Child Welfare Committee. For the effective implementation of the proposed Act and for the welfare and rehabilitation of the victims an Anti- Trafficking Fund will be created.

Digital blackmailing also has increased in the recent times. Taking objectionable photographs of females through hidden cameras (or) morphing the available pictures and threatening them by showing those photographs, became a problem. While technology is very much needed for upliftment of people, especially to the youth to have the latest knowledge and get the jobs, it becomes a problem when it is used for wrong purposes, like the above. So cyberlaws on these kind of blackmails should be strict

To the best of my ability, knowledge and experience that no law has is strictly implemented in India in true spirit and object that it was made, because of inequalities of possessing wealth among citizen and no responsibility about the Nation by the executors of the law. In order to overcome such, the Central Government at the outset has to verify exact population of India and any body possessing the wealth beyond 10times of his need and how much wealth is hided without utilizing Nations Growth

Child Helpline should be strengthened to take all kinds of desperate calls. It should also be enabled with required technology like tracing the calls, connecting to nearby police etc. Child Helpline Number should be publicized in all Schools and Public places. Children should be alerted about the possible cheating methods (Modus Operandi). They should also be offered some counseling on the related matters.

->Human trafficking should be made a non-bailable offence. ->A special team should be formed to monitor the human trafficking. This team should have independent charges to act effectively in cases of human trafficking. ->They should be provided with special warrants. ->The cases of human trafficking should be accessible throughout the nation i.e. it must be converted into national jurisdiction case. There should be easy communication between police departments of different states.

Human Trafficking is the worst form of crime as it redefines the future of a young person, into a world of Horror and irrepairable damage. To start with, a NATIONAL REGISTRY OF MISSING PERSONS should be created and all FIRs, whether trafficked or Elopement should be registered in the registry for closure. A true picture of the volume and complete data including photographs should be available for quick reference. 2. A separate police task force with exchange of intelligence is a MUST.

In the draft Trafficking Of Persons (Prevention, Protection and Rehabilitation) Bill, 2016 , following provisions must be included : 1. In case of children who were trafficked - they must be provided with a provision of education. After that then they can be provided skill training(if needed) to make them self sufficient for earning a livelihood , after the age of 18 years. 2. In case of trafficked women, those forced into a forced marriage , their marriage must be annuled immediately.

There are lakhs of illegal bangaladesh migrants in India. they do not voluntarily disclose their original nationality. for this a time bound amnesty scheme should be launched.A work permit visa should be awarded to the persons who voluntarily discloses his bangaladesh nationality. They will automatically removed from voter's list.

If you prevent it you need not have to protect and rehabilitate. If you wish to correct the damage already done you need to protect the rescued and the supporting individual or NGO. In India the whistle blower is usually betrayed by the agency that is supposed to protect. Strict action is to be taken and perpetrators to be punished swiftly and the govt. officials from police or judiciary or lawyers found guilty be meted out multiple times the punishment and you will find future easy to work.
