Ministry of Women and Child Development has formulated a draft Bill on “Trafficking of Persons (Prevention, Protection and Rehabilitation) Bill, 2016” for further consultations with all stakeholders. It aims to create a strong legal, economic and social environment against trafficking of persons and for matters connected therewith or incidental thereto.

The draft Bill has taken in to account the various aspects of trafficking and its punishments as defined in section 370- 373 of Indian Penal Code, 1860 and aims to include other offences/ provisions which are not dealt in any other law for the purpose of trafficking, such as (1) penal provisions for the disclosure of identity of the victim of trafficking and witness (2) use of narcotic drug or psychotropic substance or alcohol for the purpose of trafficking (3) use of chemical substance or hormones for the purpose of exploitation. The draft Bill has also taken in to its ambit the ‘placement agencies’ by making mandatory for them to also register for the purposes of this Act.

The proposed draft Bill aims to place dedicated institutional mechanism at District, State and Central level. It also envisages a designated Agency for the investigation of offences. It provides for Protection Homes and Special Homes for short term and long term rehabilitation support. For speedy trial with a view to increase prosecution and to reduce the trauma faced by the victims, the proposed draft Bill provides for establishing Special Courts in each district and experienced Special Prosecutors. Recovery of back wages and other monetary losses of the victim of trafficking is also proposed.

The draft Bill provides for mandatory reporting within 24 hours by a Police Officer, Public servant, any officer or employee of Protection Home or Special Home having custody of the victim of trafficking to the District Anti-Trafficking Committee or in case of child victim to the Child Welfare Committee. For the effective implementation of the proposed Act and for the welfare and rehabilitation of the victims an Anti- Trafficking Fund will be created.

I believe gov should ban the street beggars with child in their arms, this thing helps in abducting and trafficking of child in the country on very large scale. The ban will not only improve the social image of the country on international platform but also improves the life of streets child upto some extent.

On a lighter note, Why the bill ain't valid in J&K, especially when are going to fine and imprison people who dare speak J&K not an integral part of India? Or is it just that, yeah it's part of our country, but women and child of J&K, sorry? :):):):) Again, wrote that in a lighter note, no explanations required from anyone, nor need for any pitchforks.

I have reviewed Sec 370 -373 "Buying or disposing of any person as a slave" in particular and present my suggestions on the 3 aspects below for prevention of human trafficking: It is better to completely repeal all these 4 sections and rework the punishment, etc for human trafficking as part of the draft "Human Trafficking Bill, 2016". It is important to recognise that there are two categories of humans vulnerable to trafficking: 1) Children 2) Girls of all ages -esp minors for prostitution

The adoption in 2000 by the United Nations General Assembly of the Protocol to Prevent, Suppress and Punish Trafficking In Persons, Especially Women and Children marked a significant milestone in international efforts to stop the trade in people. As the guardian of the Protocol, UNODC addresses human trafficking issues through its Global Programme against Trafficking in Persons. A vast majority of States have now signed and ratified the Protocol. But translating it into reality remains problem.

Article 3, paragraph (a) of the Protocol to Prevent, Suppress and Punish Trafficking in Persons defines Trafficking in Persons as the recruitment, transportation, transfer, harbouring or receipt of persons, by means of the threat or use of force or other forms of coercion, of abduction, of fraud, of deception, of the abuse of power or of a position of vulnerability or of the giving or receiving of payments or benefits to achieve the consent of a person having control over another person,

As human trafficking generally involves criminal syndicates or criminal organizations, I have four comments: 1. Penalties should be stringent on the lines of control of organized crime laws e.g MCOCA. 2. Repeat offense should have additional penalties. Penalties for convicted govt employees should be more severe. 3. The sentences (if convicted) should not run concurrently. 4. Designated deemed courts (clause 23) until the state govts notify to avoid long delays and uneven notification.

Sir, My comments attached. I propose a complete solution to re-unite the lost children to their parents, even if they are found after 15 years or more. This solution can also help identify the dead bodies on tracks and let the relatives know of the happenings. It is a complete solution....
