The Government of India intends to introduce the Goods and Services Tax (GST) in the country at the earliest. GST seeks to subsume many indirect taxes at the Central and State level. The proposed dual GST envisages taxation of the same taxable event, i.e., supply of goods and services, simultaneously by both the Centre and the States.

The Constitution (One Hundred and Twenty-Second Amendment) Bill, 2014, has been introduced in the Parliament for facilitating the introduction of GST in the country. Simultaneously, committees comprising of officers from the Central Government, as well as the State Governments, have been constituted for the drafting of Model CGST, SGST and IGST laws, and GST business processes of registration, refunds, returns and payments.

The draft Model CGST, SGST and IGST laws, along with GST business processes for filing of returns, shall be put up for inviting comments of stakeholders in due course. Presently, the draft business processes on GST registration, GST refunds and GST payments are being published.

The Report of the Committee on GST Refunds is available here. Comments and views are invited on these business processes by 31st October, 2015. Users are requested to keep in mind the guidelines for posting their comments:

#GSTRefunds: If exports are proposed to be Zero rated, would there be any Concept of Payment of taxes at the time of export and thereafter claiming rebate thereof? #GSTRefunds: In present scenario, ITC is not denied on Zero Rated Output. Basic objective of keeping rate of taxes Zero is eligibility for Input. Hence, Input goods or services used for Zero rate supplies should be allowed instead of "Ineligible Inputs"

Lean six sigma methodology has been one of the most effective tool to reduce cost and improve efficiency. When I look around in any of the government department or process, we can easily identify lot of gaps which can be fixed and process and be improved. The suggestion is that the government can make a team of certified Black Belts who can work on various department to help achieving voice of PM.

We may not that familiar with #GST, but what we are facing, is from becoming a small company, if we want to purchase any office, the biggest difficulty we face is huge difference of actual amount, and amount in paper. Major amount is being asked in cash, while the amount of office in paper goes way down to actual amount which we are supposed to pay ! Stuff like these are biggest hurdler not allowing to pay taxes and other things honestly, and Government finds more ways to get tax. #WeNeedChange

#GSTRefunds; #GSTRefundSituations GST refunds are essentially generated from GST Payments ... GST Return must get generated automatically from the GST Payments made by the suppliers .... So the tax payer has only to file GST Payment returns there is no need to file a GST refund return .... So Refunds are automatically credited from the sales return filed by a tax payer and Buyer can verify his GST Tax Credit online so 50% WORK LOAD ON TAX PAYER IS REDUCED and work of Tax Department is reduced 60

Many Indian companies participate in Germany trade fairs & exhibitions. But, we don't get any vat refund from Germany. Only a few EU countries offer vat refund to India, where Germany is not included. As a result, we are losing a huge amount of vat refund money. Maximum no of exhibitions take place in Germany. By having a mutual treaty between India / Germany, this needs to be started. Please let us know your feedback on this point.

In respect to GST refund, There should be set-off mechanism, any amount of excess tax paid of GST, it should be set off against the next period GST, but, if assesse claims the refund of excess GST paid, it should be refunded to the assesse directly in bank accounts.The claim refund should be made available in only yearly return of GST and not in monthly/qtly return, so,that any amount of set-off tax can be calculated with simple and easy method,without any confusion in refund.
