The Telecom Regulatory Authority of India (TRAI) has been mandated by the TRAI Act, 1997 to regulate the tariffs offered by the Telecom Service Providers for its various services. Despite the amendments made to the TTO and other regulations issued by TRAI to factor in various market developments, a need has been felt to undertake a comprehensive review of the TTO framework, albeit in a phased manner, starting with a discussion on the core regulatory principles enshrined in the TTO, Directions and Advisories issued by TRAI on various aspects of the tariff framework from time to time.

In order to identify and address the various emergent issues and challenges, inter-alia, related to regulatory principles of tariff assessment e.g. transparency, promotional offers, disclosures and non discrimination, adherence to the principle of non-predatory pricing, meaning of predatory pricing, relevant market, assessment of dominant position etc., Telecom Regulatory Authority of India (TRAI) has released Consultation Paper on ‘Regulatory Principles of Tariff Assessment’ on 17th February, 2017 to solicit comments from the stakeholders.

The objective of this Consultation Paper (CP) is to bring about greater clarity in interpretation of various regulatory principles set out in the TTO in consonance with the best global practices.

Click here to read the consultation paper. The written comments on the issues raised in the consultation paper are invited from the stakeholders by 17th March, 2017.

If the violation of regulations is deliberate and blatant, there should not be any hesitation to even cancel the license of that telecom company irrespective of its reputation in the market.

The tariff regulations that are renewed from time to time must be made available in the public domain so that consumers are not taken for a ride by any telecom company. Strict action must be taken in accordance with the law on those telecom companies that violate the regulations set by TRAI. There should be no favor or prejudice and political considerations while taking action as per law. Stringent action should be taken irrespective of the reputation of the company that violates laws.

The rules and guidelines set by TRAI should be strictly and also uniformly applicable to all telecom companies without any bias and favor. Any company violating the rules and regulation set by TRAI should be given stringent punishment as per law. And also TRAI regulations should be made available in the public domain so that consumers are aware of the regulations that need to be followed by the telecom companies.Continued.
