I sold my property for a few crores . The purchaser deducted Rs 23.5 lakhs from the sale value towards TDS. But he usurped this amount and did not deposit it with the IT Deptt. I lost heavily to the tune of a few lakh rupees since rebate was not allowed on the capital gain tax returns filed by me. For no fault of mine, l am made the sufferer and the purchaser is enjoying illegally usurped money! The rule that the purchaser will deduct TDS is an absurd rule. I learnt that such a rule does not exist in general in the USA. The rule must be amended and the seller made responsibke for depositing the TDS. Second, the case must be handed over to the ACB of Patna to investigate how the sale deed was registered by the Registration Department of Bihar Government without the buyer deposiring the TDS deposit challans with the sake deed.
